qTUS BV, a private limited liability company under Belgian law with its registered office at De Vage 7, 8340 Damme and registered with the Crossroads Bank for Enterprises under number 0803.741.109 (RLE Ghent, division Bruges) (hereinafter “qTUS”, “we”, “our” or “us”), is an education and research organization specializing in livestock lung health and related digital support services.

These Terms of Use ("Terms") govern your access to and use of our online platform and training materials, designed for teaching veterinarians how to apply thoracic ultrasound in calves. By registering, accessing, or using the platform, you agree to comply with and be bound by these Terms.

Please read these Terms carefully before using the platform.

1. Eligibility

This platform is intended solely for licensed veterinarians or veterinary students and veterinary professionals under the supervision of a licensed veterinarian. By using this platform, you represent that you meet this eligibility requirement. qTUS disclaims all liability for any improper use of the platform or materials.

2. Use of Content and License Grant

All content provided on this platform, including but not limited to, videos, documents, diagrams, and course materials (collectively, "Materials"), are the intellectual property of qTUS. By purchasing training, you are granted a temporary, limited, non-exclusive, non-transferable, and revocable license to access and use the Materials solely for your personal education and professional development.

You may not, under any circumstances:

- Reproduce, share, distribute, or adapt the Materials in any form.

- Use the Materials to create or deliver any form of training (whether practical, theoretical, online, or in-person).

- Organize, host, or participate as an instructor in any training, seminar, course, workshop, or practical session—commercial or non-commercial—based in whole or in part on the knowledge or Materials provided by this platform.

- Represent yourself as a certified instructor of thoracic ultrasound in calves based on this training.

- Remove or obscure any references to qTUS as the owner and author of the Materials.

Any presentation, demonstration, or use of these Materials must clearly acknowledge qTUS as the source and retain any branding or intellectual property marks as originally provided.

You are strictly prohibited from:

- Using any part of the course content to train others.

- Delivering thoracic ultrasound training in calves for personal benefit—in any format—using knowledge gained from this platform.

- Offering training to individuals, groups, or institutions—even if not charging money.

Any such training activity, regardless of format or intent (commercial or non-commercial), is a violation of these Terms and will result in immediate termination of access and may lead to legal action, including but not limited to claims for intellectual property infringement, injunctive relief, and recovery of legal costs.

3. Platform Availability and Maintenance

qTUS reserves the right to temporarily suspend or limit access to the platform, without prior notice, for maintenance, updates, security reasons, or technical improvements.

qTUS shall not be held liable for any temporary unavailability of the platform, data loss, or reduced functionality resulting from maintenance activities, technical issues, or circumstances beyond its reasonable control.

4. System Requirements

Access to the platform requires a compatible device (computer, tablet, or smartphone) with a stable internet connection and a modern, up-to-date web browser.

The user is solely responsible for ensuring that their hardware, software, internet connection, and system configuration meet the minimum technical requirements necessary to access and use the platform before purchasing any training or license.

qTUS shall not be liable for access issues or reduced functionality caused by insufficient system compatibility, outdated software, or inadequate internet connectivity on the user’s side.

5. Course Access Duration

Unless otherwise specified, access to the online Materials is granted for a period of 12 months from the date of purchase. Upon renewal, the license shall be subject to the terms and conditions in force at that time.

6. No Guarantee of Results

The training and Materials provided are intended to improve your understanding and application of thoracic ultrasound in calves. However, we do not guarantee any specific outcomes, diagnostic accuracy, or clinical results based on your participation in the training.

7. Assumption of Risk and Limitation of Liability

You acknowledge and agree that:

- You are solely responsible for how you apply the techniques taught during the training.

- You are responsible for the safety of the animals, yourself, and your equipment during any practice.

- We are not liable for any injury, loss, or damage to people, animals, or equipment that may occur during or after the use of our platform or training.

To the fullest extent permitted by law, we disclaim all liability for any direct, indirect, incidental, or consequential damages resulting from your use of the platform or the application of the technique. 

8. Refund Policy

All sales are final. Refunds are only considered in exceptional circumstances at qTUS’s discretion and documented circumstances (e.g. serious illness or force majeure). Administrative or preparation costs may be deducted. Rescheduling may be possible. Full terms apply.

9. User Feedback

Users may, but are not obliged to, provide feedback, suggestions, comments, or ideas regarding the platform, training, or Materials (“Feedback”).

By submitting Feedback, the user irrevocably grants qTUS a worldwide, perpetual, royalty-free, and unrestricted right to use, reproduce, modify, incorporate, and exploit such Feedback for any purpose, without any obligation to provide compensation or attribution.

The user acknowledges that Feedback does not create any intellectual property rights or contractual claims against qTUS.

10. Privacy and Data Protection

Your personal data will be handled in accordance with the General Data Protection Regulation (GDPR). By using the platform, you consent to the collection and use of your personal data as described in our Privacy Policy.

11. Termination

We reserve the right to suspend or terminate your access at our sole discretion, without prior notice and without refund, if we believe you have violated these Terms or misused the platform.

12. Modifications to Terms

We may update these Terms from time to time. Continued use of the platform after such changes constitutes your acceptance of the new Terms.

qTUS reserves the right to modify its prices, fees, or subscription conditions at any time. Any subscription based price changes shall be communicated to the user at least thirty (30) days before they take effect. If the user does not agree with the price modification, they have the right to terminate the license free of charge before the new pricing becomes effective. Continued use of the platform after the effective date of the price change constitutes acceptance of the modified pricing.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Belgium. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Ghent, division Bruges, Belgium.

In the event of a dispute, both parties agree to first attempt resolution through informal negotiations or mediation before pursuing legal action.

14. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
